Mainz Loses Appeal Over El Ghazi's Wrongful Dismissal
German club Mainz has lost a court appeal regarding the wrongful dismissal of Dutch winger Anwar El Ghazi.
The Bundesliga team terminated El Ghazi's contract in November 2023 due to a series of social media posts he made concerning the Israel-Gaza conflict.
In July 2024, a German court ruled that the termination was wrongful, asserting that the player's statements were protected under freedom of expression.
Mainz appealed the ruling, but on Wednesday, the Rhineland-Palatinate State Labor Court upheld the original decision.
Club chairman Stefan Hofmann stated, "We have to accept the court's decision. However, we maintain our stance: Based on the values and convictions that define Mainz 05, the continued employment of individuals who express and behave in fundamental contradiction to these values will remain out of the question."
El Ghazi was initially suspended by Mainz on October 17, following a social media post that included the controversial phrase "from the river to the sea," which some interpret as a pro-Palestinian message implying the destruction of Israel.
This interpretation is contested by some pro-Palestinian activists, who argue that the phrase calls for an end to Israel's occupation of the West Bank and the blockade of Gaza rather than the destruction of Israel itself.
Mainz stated that El Ghazi's post "took a position on the conflict in the Middle East in a manner that wasn't tolerable for the club." The former Ajax, Lille, Aston Villa, and Everton forward returned to the squad three days later, claiming he stood "for peace above everything."
However, El Ghazi later revealed that he had not authorized a club statement confirming his return, leading Mainz to terminate his contract "in response to the player’s statements and posts on social media."
Following his court victory, El Ghazi pledged €500,000 (£441,000) of his settlement from the club to "fund projects for children in Gaza" affected by the conflict. In July 2024, he expressed hope that Mainz, despite their unsuccessful attempts to avoid making the payment, would find comfort in knowing they had contributed financially to improving the lives of children in Gaza through him.
At 30 years old, El Ghazi joined Cardiff City after leaving Mainz and is currently playing for Al-Sailiya in Qatar.
